Terms of Service
Last updated: 8 October 2026
These Terms of Service govern the use of Homesy’s web and mobile applications for managing homes, buildings, cooperatives and organisations. They explain your responsibilities, the role of Homesy and the conditions for free and paid services.
1. Who provides Homesy and who can use it?
Homesy provides the platform. Our contact address is Homesy, 1814 La Tour-de-Peilz, Switzerland, and our email is [email protected]. Contact us with questions about these terms, your account or the service.
You must be at least 18 years old to create or use a Homesy account. If you act for a cooperative, organisation, property owner or other person, you must have authority to act for them and to make any commitments you accept on their behalf.
These terms must be made available for you to read and save before you accept them when creating an account or ordering a service. A paid offer may include additional agreed conditions. Those conditions apply to the service concerned; mandatory legal rights always remain applicable. The Privacy Policy explains personal-data processing separately. Accepting these terms does not constitute consent to non-essential analytics.
2. Accounts, membership and sharing
Provide accurate account information and keep it reasonably up to date. Protect your sign-in credentials and devices, and notify [email protected] if you suspect unauthorised access. Use your own account and do not impersonate another person or claim a property-management role you do not hold.
Create or administer a building, invite members and change permissions only when you are authorised to do so. Access to building information is limited by default to authorised members of that same building, with further restrictions according to roles and individual item permissions. Membership does not automatically provide access to every task, file or record. Before the last authorised owner or administrator leaves, arrange a handover to an eligible replacement where available and preserve the records the organisation needs. If authority is disputed or an administrator is unavailable, contact [email protected]; we may request evidence of authority before assisting with a change of administrative control. An account or platform role does not by itself establish legal ownership or authority to represent an organisation.
An authorised user can explicitly share files through public links or give contractors and service companies access to a task or offer request. Those recipients can access the items and related information covered by the sharing permission. Public service-company profiles are visible outside the building. Check recipients and permissions before sharing, and withdraw access when it is no longer appropriate; downloaded copies may remain with their recipients.
3. Your content and personal data
You retain your rights in the documents, images, messages and other content you provide. You give Homesy a non-exclusive permission to host, store, copy, convert, process and display that content, and share it according to your settings, only as needed to operate the service and provide its features. This includes indexing, AI embeddings and content moderation. This permission does not transfer ownership of your content to Homesy. You grant this permission only to the extent that you hold the relevant rights or are authorised to grant them on behalf of the rights holder or organisation. Rights in shared organisational records remain with their respective rights holders. The permission ends when the content is removed from the service, except to the extent needed for continued authorised sharing, backup retention, legal obligations or specific legal claims under the Privacy Policy and any applicable data processing agreement.
Upload or share content only if you have the necessary rights and a lawful basis for including other people’s personal data. Respect confidentiality, copyright and the privacy of residents and other people. Include sensitive information only when necessary and appropriate for the activity concerned, and restrict access accordingly.
Homesy’s own infrastructure, including its databases, is hosted in Switzerland. Providers such as OpenAI process information for the functions they supply and may process it abroad. The Privacy Policy describes the data involved, recipients, retention and your rights. Account closure and content removal are handled under that policy, including any justified retention of shared records or data required by law.
4. Acceptable use and moderation
Do not use Homesy for unlawful activity, fraud, impersonation, harassment, threats or infringement of another person’s rights. Do not post sexual or adult content or graphic violence that is inappropriate for the service. Do not distribute malware, bypass access restrictions, interfere with other users or use automated requests in a way that disrupts the platform.
Homesy uses OpenAI to check text and images for adult or sexual content and violence. Automated checks can make mistakes and do not guarantee that all harmful content will be detected. We check uploaded files for viruses to help protect the service. Virus scanning is subject to technical limits and cannot guarantee detection of every threat. Content may be restricted or removed to address a breach of these terms, a security risk or a legal obligation.
To report problematic content, a misleading service-company profile or a security incident, or to request human review of a content or account restriction, email [email protected] with enough information to identify the item or decision and explain your concern. Homesy will reassess the restriction through human review, consider the information you provide and communicate the outcome and reasons where legally permitted. An automated flag does not by itself establish a breach and can be challenged through this process. Serious security or legal risks may require immediate restrictions without prior notice. Response times depend on the issue unless separately agreed; do not include unnecessary personal information in your report.
5. Platform features, service companies and AI
Homesy provides software for organising information, communication, tasks and requests. Work requested from a service company is agreed and paid for directly between the customer and that company. They are responsible for their quotations, contracts, work and payments. Homesy is not a party to those service contracts and does not guarantee a company’s work; our own obligations as the platform provider remain applicable. A service-company listing does not constitute verification or endorsement of its qualifications, insurance or legal authorisations unless expressly stated. Customers should independently check the company and its proposed work before contracting. Report suspected false profiles or misuse to [email protected]; access or profiles may be restricted under sections 4 and 7. Disputes about the company’s work should be raised with that company; complaints about Homesy’s own service can be raised with us.
For AI-assisted search, relevant source text is processed by OpenAI to create embeddings, which are stored in Homesy’s own local vector database. AI-assisted results can be inaccurate or incomplete. Check important results against the original records and obtain appropriate professional advice for legal, financial, technical or safety decisions. Do not rely solely on AI output for such decisions.
Authentication, email, maps, notifications and other functions use external providers. Their availability can affect the features concerned. Homesy is not an emergency reporting or dispatch service. Keep your own copies of important records and contact the appropriate emergency services directly when urgent help is needed. Backups support service recovery under our Privacy Policy; they are not a personal archive or a guarantee that an individual deleted record can be restored. Any agreed support, recovery or service-level commitments must be set out separately in the paid agreement.
6. Free services, paid offers and availability
Homesy offers a free service for one simple private home or apartment. Additional private homes or apartments require a paid offer. Cooperative pricing is based on the number of apartments; organisation pricing is based on the number of members. The cooperative or organisation pays for its respective paid service. The relevant offer specifies the included features and usage limits. The free offer concerns management of one private home or apartment; “simple” does not itself define storage or usage allowances. Plan specifications must explain the included features and limits, including any storage, member, attachment or AI limits, before activation or ordering. Paid offers must define how apartments or members are counted and when changes affect price. If a limit is reached, we will explain the available options and any feature restrictions. Extra charges require the payer’s acceptance. Conditions for changing to a lower plan, including treatment of existing data and access, must be disclosed before the change; a downgrade does not itself authorise deletion of shared records.
Before you commit to a paid service, a separate offer or order must specify the total price and any taxes or fees, currency, billing period, payment method, duration, renewal arrangements, cancellation procedure and refund conditions. Charges require acceptance of that offer by the payer or an authorised representative. These general terms do not themselves establish automatic renewal, a minimum paid term or a no-refund rule. Any applicable statutory withdrawal and refund rights remain in force. For an organisation or cooperative, the paid offer and any applicable data processing agreement must also specify what happens on expiry, cancellation or non-payment: notice and any opportunity to remedy non-payment, the date access ends, which service data the authorised customer can obtain, the export format and request period, any agreed transition assistance, and retention and deletion periods. An authorised customer may request retrieval of its eligible service data by emailing [email protected]. The scope, available format and delivery timeframe will be confirmed when the request is handled, subject to access rights, the applicable agreement and mandatory law. Backup retention and legal-hold exceptions must be addressed separately. Ending a subscription is distinct from deleting an individual account; these general terms do not themselves set an export deadline or promise a particular export tool.
We make reasonable efforts to keep Homesy available and address service problems. We do not promise uninterrupted availability, a particular uptime percentage or a fixed support response time unless separately agreed. Maintenance, updates and technical incidents can cause interruptions. We will give reasonable notice of planned material interruptions where practicable. This does not limit mandatory rights concerning the quality or conformity of the service.
7. Account closure, restrictions and responsibility
You can stop using Homesy and request account deletion from your profile using “Delete account”. Confirmation schedules deletion for seven days later, clears user data held by the app on the requesting device and signs you out on all devices, as described in the Privacy Policy. You can cancel during those seven days by signing back in and confirming “Restore account”; signing in alone does not cancel deletion. After permanent deletion the account cannot be restored. You can also email [email protected] for assistance; we may verify your identity. Memberships are removed on permanent deletion. Shared records remain if other real members remain, subject to the Privacy Policy; if you are the last real member of a building or service company, that building or company and its related data are also deleted. Entries for people without accounts do not by themselves keep it active. Before confirming deletion, arrange any necessary handover and preserve eligible records. Deleting the last administrator’s account is distinct from deleting the last real member’s account. Account deletion does not automatically terminate a separate cooperative or organisation paid contract or settle outstanding payments; the accepted offer and applicable law govern those matters.
We may proportionately restrict content or access for a serious or repeated breach of these terms, a security risk or a legal requirement. Where practicable, we will explain the reason and allow correction or review before taking action; urgent risks may require immediate action. If we discontinue a service, we will give reasonable advance notice where possible and respect existing paid commitments and applicable rights to remedies or refunds.
Each party is responsible for its own actions and obligations under applicable law. Nothing in these terms excludes or limits liability for fraud, intentional misconduct or gross negligence, or any liability that cannot lawfully be limited. Mandatory consumer rights, including applicable remedies for a defective digital service, are preserved. Homesy’s role as a software platform does not remove its responsibility for its own service.
8. Changes, applicable law and contact
We may update these terms to reflect changes in the service or legal requirements. The date above identifies this version. We will notify affected users reasonably in advance of material changes where practicable and obtain agreement where required. Changes do not retroactively impose charges or remove accrued rights. Material changes to a paid service, its features or its price will be communicated before taking effect, with the effective date, effect on the current paid period and available options. Existing paid commitments remain subject to the accepted agreement and mandatory law. Any applicable right to reject a change, terminate the affected service or obtain a proportionate refund will be respected. If you do not agree, contact [email protected] about ending the affected service under your existing agreement and applicable law.
Swiss law applies to these terms, without depriving consumers of mandatory protections under the law of their country of habitual residence where those protections apply. Disputes may be brought before the courts competent under applicable law. These terms do not require consumers to give up a mandatory right to bring proceedings in their home jurisdiction.
For questions, complaints, account requests or a proposed resolution of a dispute, contact Homesy at [email protected] or at Homesy, 1814 La Tour-de-Peilz, Switzerland. Contacting us does not prevent you from exercising your legal rights or seeking a remedy before a competent authority or court.
